Terms of Use and Sale
These terms govern use of this website and purchases from BROCKD Graphics LLC. By placing an order or approving a proposal you agree to them.
Website use. The website is provided for information and ordering. Content may contain errors and may change without notice.
Order acceptance. Submitting a request, adding items to a cart, or receiving a proposal is not acceptance. No agreement exists until we accept your order or you approve a proposal and we confirm it. We may decline any project.
Accurate information. You are responsible for the accuracy of the information you provide, including artwork content, spelling, dimensions, quantities, and delivery details.
Prices. Prices, lead times, and availability are as stated at checkout or in your written proposal. We may correct obvious pricing errors before acceptance; if an obvious error is discovered after payment, we will offer the corrected price or a full refund. Changes to project scope may change the price; changed pricing is presented for your approval before the changed work proceeds.
Proposal validity. Unless the proposal states otherwise, a proposal is valid for 14 calendar days. Prices and terms may change after expiration.
Payment. A proposal may require full payment or a deposit as stated in the proposal. Significant design work may require a separate design fee or an initial payment before design work begins. Production begins only after the proof is approved, the proposal is approved, and the required initial payment is received. Any remaining balance is due before shipment or local pickup.
Proof approval and production. Custom work is produced only after you approve a written proof, as described in the Custom Work and Proof Approval Policy.
Cancellation by you. Cancellation is described in the Return, Remake, and Refund Policy. In short: before design, purchasing, or production begins, refundable amounts may be returned; once work begins, completed work and unrecoverable costs may be deducted; after proof approval or production start, custom-made products are generally not cancellable except where required by law or expressly agreed.
Cancellation by us. We may cancel and refund payments received for a project we cannot or will not produce, including content we decline under the Artwork and Intellectual Property Policy.
Shipping and pickup. Shipping and local pickup are described in the Shipping Policy.
Tax. Sales tax, where applicable, is collected as required by law and shown separately.
Intellectual property. Artwork rights and portfolio use are described in the Artwork and Intellectual Property Policy.
Prohibited use. You may not use this website unlawfully, attempt to breach its security, or submit content you have no right to use.
Disclaimers. Except as expressly stated in these policies, the website and products are provided without further warranties. Nothing in these terms removes rights that cannot legally be waived, including rights involving delay, non-delivery, defect, material mismatch with the approved proof, or fraud.
Governing law (provisional draft position; flagged for legal review). These terms are intended to be governed by Florida law, with venue in Duval County, Florida, to the extent permitted by law. This clause does not waive consumer rights, small-claims rights, or any non-waivable law.
